Agreement to Terms

By accessing or using Gifter, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Use License

Free tier users are granted a limited, non-exclusive, non-transferable license to use Gifter for personal, non-commercial purposes, subject to the restrictions below.

Paid subscribers are granted an expanded license that includes access to premium features as described in their subscription plan, for personal use only.

Under this license, you may not:

  • Modify or copy the materials except for personal backup purposes
  • Use the materials for any commercial purpose or public display
  • Attempt to decompile or reverse engineer any software contained in Gifter
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or “mirror” the materials on any other server
  • Share, resell, or redistribute your subscription access or generation credits

User Accounts

When you create an account with us, you are responsible for:

  • Maintaining the security of your account and password
  • All activities that occur under your account
  • Providing accurate and complete information
  • Updating your information to keep it accurate and complete

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.

Subscription Terms

Gifter offers the following subscription plans:

  • 7-Day Trial: $0.99 for 7 days, then automatically converts to the monthly plan at $9.99/month unless canceled before the trial period ends
  • Monthly Plan: $9.99 per month, billed monthly
  • Annual Plan: $79.99 per year, billed annually (equivalent to $6.67/month)
  • Ultra AI Add-on: $5.99 per month, requires an active base subscription (trial, monthly, or annual)

All subscriptions renew automatically at the end of each billing period. You can cancel at any time through your Billing Portal, and your access will continue until the end of the current billing period.

Generation Credits

Generation credits allow you to create AI-powered gift lists without a subscription. Credits are available in the following bundles:

  • Starter Bundle: 3 credits for $2.99 ($1.00 per generation)
  • Popular Bundle: 10 credits for $6.99 ($0.70 per generation)
  • Best Value Bundle: 25 credits for $12.99 ($0.52 per generation)

Credits never expire and remain in your account until used. Each AI gift list generation consumes one credit. Unused credits are eligible for a refund within 14 days of purchase if no credits from the bundle have been used.

Seasonal Passes

Seasonal passes provide unlimited generations during specific holiday periods. Passes range from $4.99 to $9.99 depending on the season and duration. Seasonal passes are:

  • Non-refundable once purchased
  • Time-limited to the specific seasonal window
  • Cannot be transferred to another account
  • Do not include subscription features (e.g., Generate More, Refine Link)

Payment and Billing

All payments are processed securely through Stripe and PayPal, our PCI DSS Level 1 certified payment processors. We accept major credit cards, debit cards, PayPal, and other payment methods supported by our processors in your region.

If a subscription payment fails, we provide a 7-day grace period during which your subscription features remain active. You will receive email notifications at days 0, 3, and 7 to update your payment method. If payment is not recovered within the grace period, your subscription will be canceled.

You can manage your payment methods, view invoices, and update billing information through the Stripe Billing Portal, accessible from your account settings.

Cancellation and Refunds

Refund eligibility varies by product type:

  • Subscriptions: Cancel anytime via the Billing Portal. Access continues until the end of the current billing period. No partial refunds for unused time.
  • 7-Day Trial: Cancel before the trial ends to avoid being charged the monthly rate. The $0.99 trial fee is non-refundable.
  • Generation Credits: Refundable within 14 days if no credits from the purchased bundle have been used. Contact support for refund requests.
  • Seasonal Passes: Non-refundable once purchased.
  • Ultra AI Single Generation: Non-refundable once the generation has been initiated.

To cancel your subscription, go to your account settings and click “Manage Subscription” to open the Stripe Billing Portal, where you can cancel, change plans, or update your payment method.

Price Changes

We may adjust our pricing from time to time. If we change the price of your subscription, we will provide at least 30 days' notice before the new price takes effect. Existing subscribers will be grandfathered at their current rate until they cancel or change their plan.

Credit bundle and seasonal pass prices may change without prior notice, but any bundles or passes already purchased will not be affected.

Free and Paid Tiers

Gifter offers both free and paid tiers:

  • Free Tier: One AI gift list generation, unlimited manual wish lists, list sharing, and booking features
  • Subscription (Pro): Unlimited AI generations, Generate More suggestions, Refine Link for existing gifts, priority support
  • Ultra AI: Premium AI model for higher-quality, more personalized gift recommendations (available as add-on subscription or single generation purchase)

We reserve the right to modify the features included in each tier. We will notify active subscribers of any material changes to their plan features.

Use of AI Technologies

Gifter uses artificial intelligence technologies, including third-party AI providers such as OpenRouter, to generate personalized gift recommendations based on the information you provide. By using our AI-powered features, you acknowledge and agree to the following:

  • AI-generated gift recommendations are provided for informational and entertainment purposes only and do not constitute professional shopping, financial, or purchasing advice
  • AI responses may contain inaccurate, incomplete, or outdated suggestions, and Gifter does not guarantee the accuracy, reliability, or suitability of any AI-generated content
  • Product availability, pricing, and specifications referenced in AI-generated recommendations are not guaranteed and may change at any time without notice
  • You are solely responsible for verifying all information and making your own independent purchase decisions based on AI-generated recommendations
  • The quality and relevance of AI-generated recommendations depend on the accuracy and completeness of the information you provide

Gifter is not liable for any losses, damages, or dissatisfaction arising from your reliance on AI-generated gift recommendations or any purchases made based on those recommendations.

AI Output Content

Regarding the inputs you provide and the outputs generated by our AI features:

  • Your Inputs: You retain all rights to the information and content you provide to our AI features, including recipient details, preferences, and occasion information
  • Anonymized Data: Gifter retains the right to use anonymized and aggregated data derived from your inputs and AI-generated outputs to improve, train, and enhance our service and recommendation algorithms
  • No Training of Third-Party Models: You may not use AI-generated outputs from Gifter to train, fine-tune, or develop other artificial intelligence or machine learning models, whether commercial or non-commercial
  • Non-Unique Outputs: AI-generated gift recommendations may not be unique to you. Other users who provide similar inputs may receive identical or substantially similar recommendations. You do not acquire any exclusive rights to AI-generated outputs

User Content

You retain all rights to the content you create and share on Gifter, including gift lists and wish items. By posting content, you grant us a license to use, modify, and display that content as necessary to provide our services.

You are responsible for the content you post and must ensure it:

  • Does not violate any laws or regulations
  • Does not infringe on the rights of others
  • Is not offensive, abusive, or inappropriate
  • Does not contain spam or malicious code

Intellectual Property

All content, features, and functionality of the Gifter platform, including but not limited to the software, design, text, graphics, logos, icons, and overall appearance, are the exclusive property of Gifter and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your use of Gifter grants you a limited, revocable, non-exclusive, non-transferable license to access and use the service for its intended purpose. This license does not include the right to:

  • Copy, reproduce, distribute, or create derivative works based on Gifter's platform content or design
  • Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the software
  • Extract, scrape, or mine data from the service using automated tools or processes
  • Use Gifter's name, logo, or branding without prior written consent
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the platform

Any unauthorized use of Gifter's intellectual property may result in termination of your account and may subject you to civil and criminal penalties.

Third-Party Content and Product Links

Gifter allows users to add links to products and images from third-party websites (such as Amazon, Walmart, Etsy, and other retailers). By using this feature, you acknowledge and agree that:

  • User Responsibility: You are solely responsible for ensuring that any product links, images, or content you add to your gift lists do not infringe on the intellectual property rights of third parties
  • No Ownership Claim: Gifter does not claim ownership of any third-party images or content displayed through product links. All trademarks, logos, and images belong to their respective owners
  • Product Information: Product images and information are provided for reference purposes only to help gift-givers identify desired items. We do not host or store third-party images on our servers
  • No Affiliation: Unless explicitly stated, Gifter is not affiliated with, endorsed by, or sponsored by any third-party retailers or brands whose products may appear in user gift lists
  • Availability: Third-party content, including product images and links, may become unavailable at any time. We are not responsible for broken links or missing images from external sources

If you are a copyright owner and believe that content on Gifter infringes your rights, please contact us with details of the alleged infringement, and we will investigate and take appropriate action.

Prohibited Uses

You may not use Gifter:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, or state regulations, rules, or laws
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To spam, phish, scrape, or spider
  • For any obscene or immoral purpose

Content Policy

Gifter is committed to maintaining a safe and respectful environment for all users. The following content is strictly prohibited on our platform:

  • Hate speech, content that promotes discrimination, or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Harassment, bullying, threats, or intimidation directed at any individual or group
  • Content that promotes, facilitates, or references illegal activities, including but not limited to illegal substances, weapons, or stolen goods
  • Spam, unsolicited promotional content, or repetitive content designed to manipulate the service
  • Malicious content, including links to phishing sites, malware, or other harmful software
  • Sexually explicit, violent, or otherwise objectionable material
  • Content that impersonates other individuals or misrepresents your identity or affiliation

Gifter reserves the right to review, remove, or disable access to any content that violates this policy, at our sole discretion and without prior notice. We may also suspend or permanently terminate the accounts of users who repeatedly or egregiously violate these content standards.

If you encounter content that you believe violates this policy, please report it to us through the contact information provided below.

Service Availability

We target 99.5% uptime for the Gifter service. However, we do not guarantee that our service will always be available, secure, or error-free. Scheduled maintenance windows will be communicated in advance where possible.

We reserve the right to modify, suspend, or discontinue the service at any time. In the event of extended service disruption affecting paid subscribers, we will provide pro-rata credits or refunds at our discretion.

Disclaimer

The materials on Gifter are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Limitations of Liability

In no event shall Gifter or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Gifter, even if we have been notified of the possibility of such damage.

Force Majeure

Gifter shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control. Such events include, but are not limited to:

  • Natural disasters, including earthquakes, floods, hurricanes, and severe weather events
  • Epidemics, pandemics, or public health emergencies
  • Acts of government, including sanctions, embargoes, regulatory changes, or orders of any governmental authority
  • War, terrorism, civil unrest, or armed conflict
  • Cyberattacks, internet outages, or failures of third-party infrastructure or service providers
  • Power failures, telecommunications failures, or other utility disruptions
  • Labor disputes, strikes, or workforce shortages

In the event of a force majeure occurrence, our obligations under these Terms will be suspended for the duration of the event. We will make reasonable efforts to resume normal operations as soon as practicable and will notify affected users of any significant service disruptions.

Indemnification

You agree to indemnify and hold harmless Gifter and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

Class Action Waiver

You and Gifter agree that any disputes arising out of or related to these Terms of Service or the use of the service shall be resolved on an individual basis only. You hereby waive your right to participate in any class action, collective action, representative action, or consolidated proceeding of any kind against Gifter, whether in court, arbitration, or any other forum.

This class action waiver is a material and essential part of this agreement. If this waiver is found to be unenforceable with respect to a particular claim or request for relief, then that claim or request for relief shall be severed and decided individually, and the remaining claims shall continue to be subject to this waiver.

You acknowledge that by agreeing to this waiver, you may be giving up substantial rights, including the ability to participate in a class action. You confirm that you have read and understand this provision and agree to it voluntarily.

Changes to Terms

We reserve the right to revise these Terms of Service at any time. By continuing to use Gifter after changes are posted, you agree to be bound by the revised terms.

Governing Law

These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the State of Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.

Any claim or cause of action arising out of or related to these Terms of Service or the use of Gifter must be filed within one (1) year after the claim or cause of action arose, or such claim shall be permanently barred.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of these Terms, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Gifter regarding your use of the service. These Terms supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written, oral, or implied, with respect to the subject matter hereof.
